1. Who We Are

Moonlight acts as the data controller for the information you provide to us. Registered office: 15 Southampton Place, London. We operate as a specialist search firm within the design and build sector.

2. What Data We Collect

In the course of our work, we may collect and store your contact details, CV and career history, portfolio or project information, notes from meetings and conversations, salary information and expectations, right to work details where relevant, and website usage data such as cookies and analytics. We only collect information necessary for recruitment, search and advisory activities.

3. How We Collect Your Data

We gather personal data through direct conversations, emails or form submissions; CVs or documents you send to us; referrals from industry contacts; public sources such as LinkedIn or company websites; client discussions regarding potential roles; and through our website and analytics tools. We do not purchase data from third-party lists.

4. How We Use Your Data

We process your data to assess suitability for senior and specialist roles, contact you about relevant opportunities, introduce you to clients with your permission, maintain long-term professional relationships, provide market insight and career guidance, and meet regulatory or contractual obligations. We never use your data for purposes unrelated to our recruitment and search services.

5. Legal Basis for Processing

We rely on the following lawful bases under GDPR: legitimate interest, which covers most of our work such as contacting you about relevant opportunities; consent, which we request before sending your details to any client; and contractual necessity, if you become a client, contractor or placed candidate.

6. Who We Share Data With

Your data may be shared with clients we represent (only with your prior consent), professional service providers such as CRM or IT systems, background check providers where applicable, and legal or regulatory bodies where required by law. We do not sell or trade personal data under any circumstances.

7. International Transfers

Some of our technology providers may operate outside the UK or EU. Where this is the case, we ensure appropriate safeguards, such as Standard Contractual Clauses, are in place to protect your data.

8. Data Retention

We retain candidate data for up to five years from the last meaningful contact unless you ask us to delete it sooner. You may request erasure at any time.

9. Your Rights Under GDPR

You have the right to access the data we hold about you, request corrections to inaccurate information, request deletion of your data, restrict or object to certain processing, request the transfer of your data to another party, and withdraw consent at any time. To exercise these rights, contact privacy@moonlightsearch.com.

10. Security Measures

We take data security seriously. Our measures include secure password-protected systems, limited access to personal data, staff training in data protection, and the use of encrypted storage where appropriate. While no system is completely secure, we take reasonable steps to safeguard your information.

11. Cookies and Website Tracking

Our website uses cookies for essential functionality and anonymous usage analytics. You can manage or disable cookies through your browser settings.

12. Complaints

If you have concerns about how your data is handled, please contact us first. You also have the right to raise a complaint with the Information Commissioner’s Office at www.ico.org.uk.
